Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and My Real Estate Prep (“My Real Estate Prep”, “we”, “us”, or “our”) governing your access to and use of myreprep.com and any related applications, features, or content we provide (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

My Real Estate Prep is a personal online study tool for candidates preparing for state real estate licensing exams. The Service provides practice questions, AI-generated explanations, study notes, spaced-repetition review, and progress tracking. The Service is provided for educational purposes only and is not a substitute for an accredited pre-license course, legal advice, tax advice, or guidance from a licensed instructor.

2. No affiliation; no guarantees

My Real Estate Prep is independent. We are not affiliated with, endorsed by, or sponsored by any state real estate commission, examination provider (including but not limited to Pearson VUE and PSI), licensing school, brokerage, or trade association. Practice questions are written for study purposes and are not actual exam questions. We do not guarantee that you will pass any exam, achieve any particular score, or obtain or maintain any license.

3. Eligibility and accounts

  • You must be at least 16 years old and able to form a binding contract to use the Service.
  • You agree to provide accurate information when you register and to keep it current.
  • You are responsible for safeguarding your password and for all activity that occurs under your account.
  • One account per person. Do not share, sell, or transfer your account.
  • Notify us promptly at security@myreprep.com if you suspect unauthorized access.

4. License to use the Service

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own, non-commercial exam preparation. All rights not expressly granted are reserved.

5. Acceptable use

You will not:

  • Copy, scrape, bulk-download, mirror, republish, sell, or sublicense any questions, explanations, notes, or other content from the Service.
  • Use the Service or its content to train, fine-tune, evaluate, or augment any machine-learning model without our express written consent.
  • Reverse engineer, decompile, probe, or attempt to discover the source code, models, or non-public parts of the Service, except to the extent applicable law expressly permits.
  • Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, its infrastructure, or other users’ accounts.
  • Use bots, crawlers, or other automated means to access the Service, except for well-behaved indexing of pages we expose for that purpose.
  • Upload, submit, or transmit content that is unlawful, infringing, defamatory, hateful, harassing, or otherwise objectionable.
  • Misrepresent your identity or impersonate any person or entity.
  • Use the Service in any way that violates applicable law or these Terms.

6. User content

The Service lets you create content such as notes, reported questions, and feedback (“User Content”). You retain ownership of your User Content. You grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify (for formatting), and display your User Content solely to operate, improve, and secure the Service for you. You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

7. AI-generated explanations

The Service uses third-party AI providers to generate explanations and summaries. AI output can be inaccurate, incomplete, biased, or out of date, and may not reflect the most current law, regulation, or exam content. You are responsible for independently verifying anything you rely on. Do not submit confidential personal information, payment card data, government IDs, or another person’s personal information in AI prompts. AI output is not legal, financial, tax, or professional advice.

8. Fees

Some parts of the Service may be free and other parts may require payment. If we introduce paid features, the price, billing cadence, refund terms, and any free trial conditions will be shown at the point of purchase, and those terms will form part of these Terms. Unless required by law or stated otherwise at checkout, fees are non-refundable.

9. Intellectual property

The Service, including its question bank, explanations, study notes templates, design, branding, software, and underlying technology, is owned by My Real Estate Prep or our licensors and is protected by copyright, trademark, and other laws. “My Real Estate Prep” and the myreprep.com mark are our trademarks. No license to any of our marks is granted by these Terms.

10. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to legal@myreprep.com that includes: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and where it is located on the Service; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorized to act on the rights holder’s behalf; and (f) your physical or electronic signature.

11. Third-party services

The Service relies on third-party providers (for example, hosting, authentication, and AI inference) and may link to or integrate with third-party services. We are not responsible for the availability, content, or practices of third parties, and your use of their services is governed by their own terms.

12. Suspension and termination

You may stop using the Service and delete your account at any time from your Profile page. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other users, or used the Service in a way that disrupts it. Sections that by their nature should survive termination (including Sections 5, 6, 9, 13–17) will survive.

13. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, this section applies to the fullest extent permitted by law.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MY REAL ESTATE PREP OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR STUDY PROGRESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $50.

15. Indemnification

You agree to indemnify, defend, and hold harmless My Real Estate Prep and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms or any law or third-party right.

16. Governing law and venue

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Subject to Section 17, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Florida for any dispute that is not subject to arbitration.

17. Informal dispute resolution

Before filing any claim, you agree to first contact us at legal@myreprep.com and attempt in good faith to resolve the dispute for at least 30 days. This requirement does not apply to claims for injunctive relief relating to intellectual property or unauthorized use of the Service.

18. Changes to the Service and Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms from time to time. When we do, we will update the “Effective” date above and, for material changes, provide additional notice through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.

19. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
